2. Services Description
MenuTap provides multilingual menu translation and digital menu hosting services for restaurants and food service establishments. Our services include:
- Menu translation into multiple languages
- Digital menu hosting
- QR code generation
- Menu management system
3. Account Registration
3.1. To use our services, you must create an account and provide accurate information.
3.2. You are responsible for maintaining the security of your account credentials and all activities that occur under your account.
3.3. You must be at least 18 years old to create an account.
3.4. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations, including those related to data protection and privacy.
4. User Content
4.1. You retain all rights to your original menu content.
4.2. You grant us a non-exclusive, worldwide, royalty-free license to translate, display, modify, and distribute your menu content as necessary to provide our services.
4.3. You warrant that your menu content does not infringe on any third-party rights, is not misleading, and does not violate any applicable laws or regulations.
4.4. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise inappropriate.
5. Subscription and Payments
5.1. Service fees are billed according to your selected plan (monthly, quarterly, or annual).
5.2. All fees are non-refundable unless otherwise stated or required by law.
5.3. We reserve the right to modify our pricing with 30 days notice.
5.4. You are responsible for all taxes applicable to your use of the services.
5.5. By providing payment information, you represent and warrant that you are authorized to use the payment method and agree to have your payment method charged for the selected plan.
6. Service Availability
6.1. We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
6.2. We may perform maintenance with advance notice when possible.
6.3. We reserve the right to modify, suspend, or discontinue the services (or any part thereof) at any time with or without notice.
7. Termination
7.1. You may cancel your subscription at any time through your account dashboard or by contacting us at contact@menutap.biz.
7.2. We may terminate or suspend your account without prior notice or liability if you breach these Terms.
7.3. Upon termination, your right to use the services will immediately cease, and we may delete or retain your content at our discretion.
8. Intellectual Property
8.1. The MenuTap platform, including its software, features, graphics, and user interface, is owned by us and protected by copyright, trademark, and other intellectual property laws.
8.2. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code, without our written permission.
9. Limitation of Liability
9.1. Our services are provided "as is" without warranties of any kind, either express or implied.
9.2. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
9.3. Our total liability for any claims under these Terms shall not exceed the amount you paid to us for the services in the 12 months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless MenuTap, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the services or violation of these Terms.
11. Dispute Resolution
11.1. These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
11.2. Any dispute arising from or relating to these Terms or the services shall be resolved exclusively in the courts located in Berlin, Germany.
11.3. You agree to first attempt to resolve any disputes informally by contacting us at contact@menutap.biz.
12. Changes to Terms
12.1. We may update these Terms at any time by posting the revised version on our website.
12.2. Your continued use of our services after the changes take effect constitutes your acceptance of the revised Terms.
12.3. If the changes are material, we will provide notice as appropriate, such as by email or by a prominent notice on our website.
13. General Provisions
13.1. These Terms constitute the entire agreement between you and MenuTap regarding your use of our services.
13.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
